We understand that bringing one of our precious puppies into your family is a significant decision, and we want to ensure that the entire process is clear and straightforward. Our contracts are carefully crafted to safeguard the interests of you as the buyer, us as the breeder, and most importantly, the well-being of our puppies. To help you navigate this journey with confidence, we’ve outlined the key terms and conditions in simple, easy-to-understand guides.

Understanding Our Payment Plan Contract

1. Introduction

The Payment Plan Contract is a formal agreement between you (the Buyer) and Tamara Nickey (the Seller). It outlines the terms of your payment plan for purchasing a puppy.

2. Payment Terms

  • Balance: This is the total cost of your puppy, including your chosen package type, any additional fees like vaccinations, shipping, or paperwork.

  • Deposit: You'll need to make a deposit equal to half of the balance before taking your puppy home. This deposit will also be considered your first payment.

  • Payment Plan Fee: There's a non-refundable fee of $200 or 10% of the total balance (whichever is greater) that you'll need to pay when you sign the contract.

  • Payment Schedule: Payments can be spread over 4 to 6 weeks, depending on how much remains after the deposit. Payments are due weekly or biweekly, as agreed upon.

  • Early Payment: If you pay off the balance two weeks early, we'll refund your Payment Plan Fee.

  • Late Payments: Late payments incur a $30 fee, with an additional $10 for each day late. If your payment is six days late, we may reclaim the puppy.

3. Bringing Your Puppy Home

  • Pickup: You can pick up your puppy at or near the Seller’s residence at no cost.

  • Delivery: If you need your puppy delivered within 20 miles of the Seller’s town, it's free. If further, a fee of $0.65 per mile will apply for the round trip.

  • Shipping: If shipping is required, you'll need to arrange and cover all associated costs.

4. Buyer’s Obligations

  • Care and Maintenance: You’re responsible for providing all the necessities for your puppy, including food, water, and medical care.

  • Living Arrangements: The puppy must live at your address until the balance is fully paid. You’ll need to show proof of the puppy’s living environment through a video call.

  • Weekly Video Calls: We’ll check in with you weekly to ensure your puppy is thriving. A call can be rescheduled within 24 hours of the original appointment, but this needs to be arranged prior to the missed appointment.

  • Maintain Standards: If the puppy’s care doesn’t meet our requested standards, you’ll have 48 hours to make corrections. If the puppy is severely mistreated, we have the right to reclaim it immediately.

5. Ownership and Transfer

  • Retention of Ownership: The puppy and all related documents remain the property of BCDD until you've paid the full balance.

  • No Transfer Before Payment: You cannot sell, gift, or rehome the puppy until the balance is paid in full. Attempting to do so could lead to reclaiming the puppy.

6. Liability

Once the puppy is in your care, we are not liable for any illness, injury, or death that may occur. You will be responsible for any associated costs, and if the puppy passes away due to such circumstances, you will be responsible for all payments.

7. Returning the Puppy

If you decide to return the puppy, we will cancel any future payments once the puppy is back with us. You may be eligible for a refund at our discretion, but you'll need to cover any return expenses.

8. Identification and Verification

You’ll need to provide a copy of your government-issued ID when signing the contract. Additionally, we’ll verify your living environment via video before delivering the puppy.
