1. Introduction

1.1 Introduction: This Reservation Contract ("Contract") is made effective as of [Date] ("Effective Date"), by and between Tamara Nickey (“Seller”), operating under Basset Cravings and Doodle Desires (”BCDD”), and [Buyer’s Full Name] ("Buyer"). The Seller and Buyer are collectively referred to as the "Parties" and individually as a "Party." This contract outlines the terms and conditions for the reservation of a puppy.

2. Deposit Terms

2.1 Deposit Requirement: a) A non-refundable deposit of $350 is required to reserve a puppy. b)This deposit must be paid prior to making a puppy selection.

2.2 Single Reservation: a) One deposit is applicable to one puppy reservation only. b) If the Buyer wishes to reserve additional puppies, an additional deposit of $350 per puppy is required.

2.3 Credit Towards Final Purchase: The deposit will be credited to the final purchase price of the reserved puppy.

2.4 Non-Guarantee of Ownership: The payment of the deposit and reservation of a puppy does not guarantee ownership or the final purchase of the puppy.

3. Reservation Process

3.1 Selection Window: After the deposit is paid, the Buyer has 48 hours to make a selection from the available puppies for reservation.

3.2 Weekly Updates: After the deposit is paid and a puppy is reserved, the Breeder will provide the Buyer with a minimum of one verified video and update per week until the puppy is ready to go to its new home.

3.3 Additional Updates: Any additional updates beyond the weekly requirement are at the sole discretion of the Breeder.

4. Withdrawal and Termination

4.1 Withdrawal by Buyer: If the Buyer decides to withdraw their selection, the deposit will be reserved for use on another puppy from the same litter or a later litter, depending on availability.

4.2 Termination by Breeder: The Breeder reserves the right to terminate this Contract at their discretion. If the Breeder terminates this Contract for any reason, the deposit will be returned to the Buyer, and the puppy selection will be void.

4.3 Life-Threatening Ailments or Injury: If the reserved puppy contracts a life-threatening ailment, injury, or dies while in the care of the Breeder, this Contract will be terminated. The Buyer will have the option to apply the deposit to a different puppy selection or receive a refund of the deposit.

5. Disclaimer and Limitations

5.1 Size and Color: The Breeder cannot guarantee the final size or color of the puppy due to unpredictable changes and developments during its growth.

5.2 Temperament: The Breeder cannot guarantee the puppy's temperament, as various environmental factors influence a puppy's development.

6. Dispute Resolution

6.1 Initial Resolution: Any disputes arising from this Contract shall first be attempted to be resolved civilly between the Parties.

6.2 Legal Action: If a dispute cannot be resolved amicably, or if the dispute escalates,  the Buyer agrees to cover all expenses incurred by the Seller, including but not limited to court fees and attorney’s fees.

7. Formalities and Jurisdiction

7.1 Governing Law: This Contract shall be governed by and construed in accordance with the laws of the state of Ohio, without regard to its conflict of law principles.

7.2 Jurisdiction: Any legal action or proceeding arising out of or related to this Contract shall be brought exclusively in the courts of Portage County, Ohio. The Parties consent to the jurisdiction and venue of such courts.

7.3 Entire Agreement: This Contract constitutes the entire agreement between the Parties and supersedes any prior or contemporaneous understandings, agreements, or representations, whether oral or written, regarding the subject matter herein.

7.4 Amendments: No modification or amendment of this Contract shall be effective unless in writing and signed by both Parties.

7.5 Severability: If any provision of this Contract is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

7.6 Counterparts: This Contract may be executed in counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.

7.7 Assignment: Neither Party may assign their rights or obligations under this Contract without the prior written consent of the other Party.

8. Agreement: By signing below, the Buyer acknowledges that they have read, understood, and agree to the terms of this Reservation Contract.
